Terms of Service

Welcome to FleyeMaps. These Terms of Service ("Terms") govern your access to and use of the FleyeMaps platform and services ("Service") provided by Kourstec LTD ("Company," "we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Definitions

  • "Service" means the FleyeMaps SaaS platform, including all web applications, APIs, dashboards, embedded widgets, and related documentation.
  • "Tenant" means a customer organisation provisioned on the platform.
  • "User" means any individual who accesses the Service under a Tenant account.
  • "Subscription" means the paid plan selected by a Tenant, as described in the Subscription Agreement.

2. Eligibility

You must be at least 18 years old and have the authority to bind your organisation to these Terms. By using the Service on behalf of an organisation, you represent that you are authorised to do so.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

4. Licence Grant

Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your internal business purposes during the subscription term.

5. Restrictions

You shall not:

  • Reverse engineer, decompile, or disassemble any part of the Service
  • Redistribute, sublicence, or resell the Service or any data obtained through it
  • Use the Service to build a competing product
  • Circumvent any access controls, rate limits, or security measures
  • Introduce malicious code or attempt to gain unauthorised access to other Tenants' data

6. Flight Data

Flight data displayed through the Service is sourced from third-party providers and is provided "as is." We do not guarantee the accuracy, completeness, or timeliness of flight data. You shall not redistribute raw flight data obtained through the Service without separate authorisation.

7. Payment Terms

Fees are billed in advance on a monthly or annual basis as described in your Subscription Agreement. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' written notice.

8. Data Retention on Cancellation

Upon cancellation or termination, your Tenant data will be retained for 30 days and then permanently deleted. You may request an export of your data during this retention period.

9. Service Level

Service level commitments vary by subscription tier and are described in the applicable Subscription Agreement. We will use commercially reasonable efforts to maintain Service availability.

10. Suspension and Termination

We may suspend or terminate your access if you breach these Terms, fail to pay applicable fees, or if required by law. You may cancel your subscription at any time through the billing portal; cancellation takes effect at the end of the current billing period.

11. Intellectual Property

The Service, including all software, designs, trademarks, and documentation, is owned by Kourstec LTD. FleyeMaps is a trademark of Kourstec LTD. Nothing in these Terms transfers any intellectual property rights to you.

12. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.

13. Indemnification

You agree to indemnify and hold harmless Kourstec LTD and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or breach of these Terms.

14. Modifications

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use after changes constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of [INSERT JURISDICTION]. Any disputes shall be resolved in the courts of [INSERT JURISDICTION].
